TERMS & CONDITIONS
Welcome to Soul Athletic Club! These Terms & Conditions outline the rights and responsibilities of
both Soul Athletic Club and our members. By signing this agreement, you acknowledge that you
have read and understood these terms and agree to abide by them during your membership.
Definitions
Soul Athletic Club, We, Us, Our: Soul Athletic Club Pty Limited, ABN 37 656 731 770, located at Suite 2/357 Military Rd, Mosman 2088.
You, Your, Member: Refers to the individual who has signed up for membership, which may differ from the person paying for the membership. This includes the parent/guardian if the member is under 18 years of age.
Club: Refers to any Soul Athletic Club facility.
Agreement: The contract between you and Soul Athletic Club.
Minimum Term: The minimum duration specified in your membership agreement.
Code: The operational code for equipment use, behaviour, and other rules outlined in these
Terms & Conditions.
Stripe: The payment processor used by Soul Athletic Club to manage direct debits.
Corporate Partners: Employers or organisations partnering with Soul Athletic Club to offer discounted memberships for employees.
Supply Period: The period of your membership, either fixed-term or ongoing.
Health & Safety
By signing this Agreement, you confirm that you are medically fit to participate in physical activities and use Club facilities.
You acknowledge that exercise can be physically demanding and may involve certain risks.
You participate at your own risk and responsibility.
Membership Fees & Payments
You authorise Soul Athletic Club (or Stripe, as its payment processor) to debit your nominated account for membership fees.
Membership fees will be debited as per the terms outlined in the Agreement. You are responsible for ensuring payments are made on time.
Member Conduct & Club Rules
Members must adhere to the Club Code, which includes respect for staff, other members, and the Club facilities.
You are responsible for following all safety instructions when using equipment.
Age Policy
14-17 years: Members in this age group require parental consent and must be aware of the equipment they use. If unsure, a parent or guardian must be present at the Club.
Personal Training
Personal training is not permitted at Soul Athletic Club. Only authorised staff may provide assistance in the Club. Unauthorised personal training is strictly prohibited.
Membership Freeze Option
Members can freeze their membership for a minimum of 2 weeks and up to a maximum of 4 weeks each calendar year, at a fee of $5 per week, unless specified otherwise in the membership agreement.
Freeze requests must be submitted at least 3 days in advance via email to reception@soulathleticclub.com.au.
Any freeze period will not be counted towards your Minimum Term, and the term will be extended by the duration of the freeze.
Parking
Members are welcome to park in the designated parking areas. However, parking is at your own risk, and the Club is not responsible for any damage or loss.
Contractors & Outside Providers
Soul Athletic Club does not permit any personal trainers or outside providers to operate within the Club. Any claims related to services provided by outside contractors should be directed to them.
Cancellation & Termination
Permanent Illness or Injury: If you are permanently unable to use the Club’s facilities due to illness or injury, you may terminate your Agreement with a medical certificate. Please note, management may require a 30-day notice period.
Cancellation Fees: If you wish to cancel your membership before the end of your minimum term,
cancellation fees will apply based on the remaining term:
12 months or more remaining: $550 cancellation fee
6-12 months remaining: $450 cancellation fee
Less than 6 months remaining: $300 or the amount of future fees, whichever is less
After the Minimum Term Expiry: After you’ve completed your minimum term, your membership will automatically roll into a week-to-week membership. To cancel this membership, you are required to provide 30 days' notice.
Club Closure
If the Club is closed for any reason (e.g., refurbishment, external factors), your membership will be frozen, and no charges will apply during the closure period.
Liability
To the extent permitted by law, Soul Athletic Club and Stripe are not responsible for any injuries, damage, or losses incurred during your membership.
Changes to Terms
Soul Athletic Club reserves the right to amend these Terms & Conditions. Any changes will be communicated to members in writing, and continued membership will indicate acceptance of the updated terms.
